从国际经验到本土实践：提升我国标准必要专利反垄断规则的思考

摘要：

【目的】探讨标准必要专利（SEPs）在全球技术竞争和市场发展中的关键作用，特别是针对SEPs的反垄断规制问题，分析其对市场竞争和技术进步的影响。【方法】通过聚焦SEPs反垄断规制的全球典型问题，调研了美国、欧盟和日本在此方面的实践和经验，采用比较分析的方法，深入探讨了不同国家和地区对于SEPs反垄断规制的做法。【结果】揭示了SEPs反垄断规制在全球范围内的复杂性和多样性，以及其对维护市场竞争秩序和促进技术进步的重要性。同时，总结了美国、欧盟和日本在SEPs反垄断规制方面的实践经验和有效做法。【结论】提出了对我国SEPs反垄断规制具有借鉴意义的启示，为相关政策制定者、法律实务者及学术研究者提供了宝贵的参考，有助于我国在全球技术竞争和市场发展中更好地应对SEPs反垄断规制挑战。

Abstract:

[Objective] This paper aims to explore the key role of Standard Essential Patents (SEPs) in global technological competition and market development, particularly in addressing antitrust regulations related to SEPs, and analyze their impact on market competition and technological progress. [Methods] By focusing on the global typical issues of anti-monopoly regulation of SEPs, this paper investigates the practices and experiences of the United States, the European Union, and Japan in this regard. Using a comparative analysis method, it analyzes the practices of different countries and regions in antimonopoly regulation of SEPs. [Results] This paper reveals the complexity and diversity of antitrust regulations for SEPs on a global scale, as well as their importance in maintaining market competition order and promoting technological progress. At the same time, the practical experience and effective practices of the United States, the European Union, and Japan in antimonopoly regulation of SEPs are summarized. [Conclusion] This paper provides valuable insights for China’s anti-monopoly regulation of SEPs, providing valuable reference for relevant policy makers, legal practitioners, and academic researchers. It will help China better respond to the challenges of anti-monopoly regulation of SEPs in global technology competition and market development.
