涉智能网联汽车数据的标准与法律规制困境

摘要：

智能网联汽车产业的发展引起了对车辆数据采集、处理、传输和存储需求的大量增加，同时，由于在汽车内外设置了大量可以收集位置、驾驶行为、通讯浏览记录、环境信息等数据的设备，导致数据安全问题成为智能网联汽车发展的关键挑战之一。然而，智能网联汽车有关数据的标准与法律存在差异与冲突，引发了二者协调性不足的困境。针对相关问题，更需要加强法律和标准的协同，强化“技术—制度”协同演化机制，建立健全数据保护体系，加强数据安全保护，使智能网联汽车更安全、可靠地行驶在制造强国建设道路之上。

Abstract:

The rise of intelligent connected vehicles (ICVs) has led to a significant increase in the demand for data collection, processing, transmission, and storage in vehicles. However, the devices for extensive collection of data, including location, driving behavior, communication browsing history, environmental information both inside and outside the vehicle have made data security one of the key challenges in the development of ICVs. Unfortunately, there exist differences and conflicts between the standards and legal regulations pertaining to data in ICVs, resulting in a lack of coordination between the two. To address these issues, it is crucial to enhance the synergy between laws and standards, strengthen the “technology-system” collaborative evolution mechanism, establish a robust data protection system, and enhance data security measures. These efforts will ensure that ICVs can operate more safely and reliably, contributing to the construction of a manufacturing powerhouse.
