地理标志标准化的政府与市场共治模式探讨

摘要：

地理标志是重要的知识产权，标准化在支撑地理标志保护方面发挥着基础作用。国家知识产权局《地理标志保护和运用“十四五”规划》明确提出，健全地理标志标准化体系，夯实地理标志保护和管理基础。本文通过欧美地理标志标准化的对比分析，结合国内标准化改革要求，提出强化地理标志标准化的政府与市场协同共治模式，建议由市场主体主导地理标志产品标准制定，政府强化质量监督，同时加快推进地理标志立法，强化地理标志产品标准的法律责任配置。

Abstract:

Geographical indication (GI) is an important category of intellectual property rights. Standardization plays a fundamental role in supporting the protection of GI. The GI Protection and Application Plan for the 14th Five-Year Plan Period (2021-2025) issued by the China National Intellectual Property Administration proposes to improve the GI standardization system, strengthen the foundation for GI protection and management. Comparing the standardization of GI in Europe and America, and considering the requirements of domestic standardization reform, this article proposes a collaborative governance model between the government and the market to strengthen the standardization of GI. It is recommended that market players lead the development of GI product standards, the government strengthens quality supervision, and the GI legislative process is accelerated to improve the legal liability allocation in case of non-conforming the GI product standards.
