国外标准必要专利政策新趋势及其对我国的启示

摘要：

近年来，基于标准必要专利在超链接社会背景下的战略意义及陷入混乱的标准必要专利全球诉讼现状，欧、 美、英、日、韩等国家或地区纷纷采取了一系列立法或非立法行动，以抢占全球SEP规则话语权、打造争议解决优选地。欧美国家的政策天平逐渐向标准实施方尤其是中小企业倾斜，以配合其产业发展战略目标，实现经济的数字化和绿色化转型；日韩则着眼于构建以SEP为核心的知识产权推进计划。总体上，我国应参考日韩的做法，实施SEP推进计划，促进技术、专利与标准协同发展。另外标准化行政管理部门应根据政府类标准与市场类标准的不同特点，制定不同类别标准涉及专利的管理办法，避免直接套用国外标准化管理组织的知识产权政策，构建公平合理的SEP制度，吸引国内外创新企业积极参与团体标准制定，促进我国建立国际性标准组织。

Abstract:

In recent years, based on the strategic significance of standard essential patents in the context of the hyperlink society and the chaotic global litigation status of standard essential patents, countries or regions such as Europe, the United States, the United Kingdom, Japan and South Korea have taken a series of legislative or non-legislative actions, to seize the right to speak in the global SEP rules and create the best place for dispute resolution. The policy balance of European and American countries is gradually tilting towards standards implementers, especially small and medium-sized enterprises, in order to match their industrial development strategic goals and realize the digital and green transformation of the economy. Japan and South Korea focus on building an intellectual property promotion plan with SEP as the core. In general, China should refer to the practice of Japan and South Korea, implement the SEP promotion plan, promote the coordinated development of technology, patents and standards. In addition, the standardization administrative department should formulate management measures for different types of standards involving patents based on the different characteristics of government standards and market standards, avoid directly applying the intellectual property policies of foreign standardization management organizations, and build a truly fair and reasonable SEP system to attract domestic and foreign innovative enterprises to actively participate in the formulation of association standards, and promote the establishment of an international standardization organization in China.
